These Terms & Conditions ("Terms") govern your access to and use of the TrueClaimRates platform, websites, and services (the "Service") operated by TrueClaimRates ("TrueClaimRates", "we", "us", or "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who you are contracting with

The Service is provided by TrueClaimRates. When you create an account or purchase a subscription you are entering into a binding agreement with TrueClaimRates.

2. Eligibility and accounts

You must be at least 18 years old and, if registering on behalf of an auto body shop or other business, you represent that you have authority to bind that organization. You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information and keep it current.

3. Description of the Service

TrueClaimRates is a public ledger of verified collision-repair labor rates, line items, and insurer payment behavior, submitted by repair shops and independently reviewed. Paid subscriptions unlock additional data, filters, exports, and forum features.

You retain ownership of repair bills, notes, photos, and other content you submit ("Submissions"). You grant TrueClaimRates a worldwide, non-exclusive, royalty-free license to host, store, redact, aggregate, analyze, display, and otherwise process Submissions for the purpose of operating and improving the Service. You are responsible for ensuring that customer PII (names, VINs, claim numbers in restricted states, addresses) is removed or that you have a lawful basis to provide it; we apply additional automated and human redaction before public display.

6. Intellectual property

The Service, including its software, design, branding, aggregated data products, and documentation, is owned by TrueClaimRates and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service within the plan you have purchased. You may not reverse engineer, resell, sublicense, or circumvent technical limits of the Service.

7. Payments, subscriptions, taxes and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax collection, currency conversion, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time through your billing portal or through paddle.net. Refunds are handled per our Refund Policy.

8. Service availability and warranties

The Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or that the data displayed is complete or accurate for any particular purpose. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. TrueClaimRates data is informational and is not legal, financial, or professional advice.

9. Limitation of liability

To the fullest extent permitted by law, TrueClaimRates's aggregate liability arising out of or related to the Service is limited to the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, data, or goodwill. Nothing in these Terms excludes liability for fraud, willful misconduct, death, or personal injury where such exclusion is prohibited by law.

10. Indemnification

You agree to indemnify and hold TrueClaimRates harmless from any claims, damages, or expenses arising out of your Submissions, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

11. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, for: material breach of these Terms, non-payment, suspected fraud or security risk, submission of falsified bills, or repeated or serious violations of the acceptable-use rules. On termination your right to use the Service ends; aggregated, redacted data already published may remain on the Service.

12. Changes to the Service or these Terms

We may modify the Service and these Terms from time to time. Material changes will be communicated by posting an updated version on this page. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws rules. The exclusive venue for any disputes is the state or federal courts located in Maricopa County, Arizona, except where prohibited by law.

14. Assignment and force majeure

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond reasonable control.
